Terms and Conditions
1.About Momentum Marketing
Momentum Marketing is a Canadian digital agency providing services including, but not limited to:
Website design and development
Branding and creative design
Digital consultancy
User experience design
Social media asset creation
Logo and identity packages
We are committed to delivering high-quality digital solutions with transparency and a zero-risk payment process.
2. Service Scope
Momentum Marketing provides services based on the agreed project scope, confirmed through:
Written proposals
Email confirmation
Signed agreements
Invoices
Online form submissions
The project scope includes deliverables, timelines, revision cycles, and technical requirements. Additional work outside the agreed scope may require a separate quote and approval.
3. Project Process
Our standard process includes:
Discovery & Requirements
Initial Drafts or Mockups
Revisions
Final Delivery
Client Approval
Final Payment & Handover
This structured process ensures clarity, transparency, and minimized dispute risk.
4. Payment Terms
4.1 No Upfront Payment
Momentum Marketing does not charge upfront for custom digital service projects.
4.2 Payment Upon Completion
Payment is only requested after the project has been completed and the Client confirms satisfaction.
Accepted approval methods:
Email confirmation
Message confirmation
Accepting final deliverables
Sign-off form
4.3 Invoicing
Once approved, an invoice will be issued. Payments may be completed through Stripe, bank transfer, or other approved methods.
4.4 Release of Final Deliverables
Full access, source files, and production-ready assets are delivered after payment is received.
5. Revisions Policy
Projects include defined revision cycles (typically 1–3). Additional revisions or major scope changes may require additional cost with Client approval.
Revisions do not cover:
Full redesigns
New features/pages not in original scope
Fundamental project direction changes
6. Refund & Cancellation Policy
6.1 Zero-Risk Payment Structure
Because payment is collected only after work is completed to the Client’s satisfaction, refunds are generally unnecessary.
6.2 Client Cancels Before Completion
If the Client cancels before reviewing final work:
No payment is required
Momentum Marketing retains all ownership of work produced up to cancellation
6.3 After Approval & Payment
Once the Client:
Approves the final deliverables
Completes payment
Receives handover
All sales are final, as digital services have been fully delivered.
6.4 Dispute Resolution
The Client agrees to contact Momentum Marketing to resolve any concerns before initiating a chargeback or dispute, allowing us to resolve issues promptly and professionally.
7. Delivery of Services
After payment, Momentum Marketing delivers final files, assets, or credentials, which may include:
Website files or live deployment
Branding packages (PNG, JPG, SVG, PDF, AI, EPS)
Social media kits
Brand guidelines
Login credentials
Delivery is completed digitally through email or secure file-sharing.
8. Client Responsibilities
Clients agree to:
Provide accurate project information
Supply necessary materials (text, images, logins, etc.)
Review drafts promptly
Communicate clearly
Approve work in writing before invoicing
Delays in communication may affect timelines.
9. Intellectual Property
9.1 Ownership Before Payment
Momentum Marketing retains full ownership of all work until payment is received.
9.2 Ownership After Payment
Upon full payment, all finalized deliverables become the Client’s property unless otherwise specified.
10. Third-Party Tools & Services
Some projects may require third-party software, hosting, or integrations. Any associated fees from third parties are the Client’s responsibility unless explicitly agreed upon.
11. Warranty & Support
Momentum Marketing provides up to 30 days of post-delivery support, covering:
Minor technical issues
Small corrections
Assistance with delivered files
Additional support packages may be purchased separately.
12. Limitation of Liability
Momentum Marketing is not liable for:
Loss of revenue
